Processing and protection of personal data

About us

The personal data you provide are processed by Data Servis – informace s.r.o. with registered office at Jaklovecká 1379/9, Slezská Ostrava, 710 00 Ostrava, IČ 25822683, VAT CZ25822683.

The processing of personal data is an essential part of our business. Without the provision of personal data and without its processing, we would not be able to provide you with our services, enter into a contractual relationship with you and fulfil our obligations arising from it. Where your consent is required for the processing of your personal data, we will not enforce or condition your consent in any way by threatening to refuse to enter into a contractual relationship, to provide a service for the sale of goods or to perform an obligation imposed by us.

We handle your personal data within the limits of generally binding legal regulations and take care to prevent any unauthorised use or misuse. The protection of personal data, the protection of privacy and the rights of each individual is one of the basic values that the employees of Data Servis – informace s.r.o. adhere to.

Our employees are fully aware of the value and sensitivity of the personal data they come into contact with and work with. They are fully aware of the damage that the disclosure, destruction or alteration of this data can cause to every single owner of this data, to every single one of you.

Data Servis – Information Ltd. and each employee of the company are personally committed to protecting the confidentiality, availability and integrity of the personal data they come into contact with and work with, as they consider it a matter of their personal professional honour, regardless of whether they are obliged to do so by law. The personal data with which our employees come into contact and work will never be disclosed, improperly transferred, altered or destroyed, outside the scope of their job description. In order to avoid unintentional disclosure, destruction or alteration of the personal data with which they come into contact and work, our employees receive regular training in this area.

Each of our employees makes every effort to prevent the disclosure, destruction or alteration of personal data with which they come into contact and work. This means observing information security measures, protecting personal data in paper form, being aware of his/her surroundings and immediately reporting any suspicious behaviour by computer technicians, colleagues or third parties.

Data Servis – Information Ltd. and its every single employee devote their best efforts to ensure fair and transparent processing of personal data; to this end, processes are developed and continuously improved so that every subject has an answer to any question regarding their personal data and its processing at any time.

What personal data we process about you?

The personal data that you provide us with and that we process is used to conclude and perform the contract, without this data this would unfortunately not be possible. These are:

  • Name and surname
  • Address
  • Telephone number
  • Email address
  • Bank address, bank account
  • In case of recruitment process, your CV or photo. 

On what legal basis do we process your personal data?

The personal data you provide above is processed on the basis of the legal basis set out below:

  • Performance or conclusion of a contract
    • Purchase and sale of goods and services, invoicing, mutual communication
  • Performance of a legal obligation
    • Obligation under Czech law or EU law – Accounting Act, Labour Code, Social Security Acts. Laws and regulations of the Czech Republic – Law on the Accounting System, Law on Social Security and Employment, Law on Insurance, Law on Legalization of Proceeds from Crime (AML), etc.
  • Legitimate interest
    • Asset protection (CCTV), forwarding within our company/organization for administrative purposes, direct marketing.

Who we provide your personal data to?

We only share your personal data within our company Data Servis – informace s.r.o. Your personal data may be further disclosed and made available to third parties to the extent necessary. These are the recipients listed below:

  • Our suppliers for logistics (delivery of goods and services) – contract performance.
  • Our partners to ensure registration, complaints and obtain feedback to improve the goods and services provided to our customers – legitimate interest (improvement of goods and services).
  • Audit companies, tax advisors – legal compliance.
  • IT companies – on the basis of legitimate interest. This includes outsourcing of IT services and possible access to personal data in the context of IT systems management.
  • Government authorities – tax authorities, health insurance companies, social insurance companies, courts, bailiffs, etc. – on the basis of fulfilling a legal obligation.

We bind any entity/third party to whom we transfer your personal data for the above purposes (unless it is for the performance of a legal obligation) by a contract which provides, inter alia:

  • The obligation to protect personal data
  • Duty of confidentiality
  • Obligation to cooperate in monitoring compliance with the provisions of the GDPR

Transfer of your personal data abroad

We only share your personal data within the scope of our company Data Servis – informace s.r.o. Your personal data may be further disclosed and made available to third parties to the extent necessary. These are the recipients listed below:

  • Our partners to provide registration, complaints and to obtain feedback to improve the goods and services provided to our customers – legitimate interest (improvement of goods and services).

We bind any entity/third party to whom we transfer your personal data for the above purposes (unless it is for the performance of a legal obligation) by a contract which provides, inter alia:

  • The obligation to protect personal data
  • Duty of confidentiality
  • Obligation to cooperate in monitoring compliance with the provisions of the GDPR

How long we keep your personal data?

We store your personal data depending on the purpose for which we process the personal data. We keep your personal data for at least the duration of the contract. In most cases, we are obliged to store your personal data in accordance with the law (Accounting Act, Labour Code, Social Security Acts). Security and Employment Act, Insurance Act, Act on the Legalization of the Proceeds of Crime (AML), etc.) this is usually for a period of 10 years.

Processing of cookies, tracking of IP addresses and other means of technological tracking

We do not use means for tracking, analyzing and evaluating cookies, IP addresses and other electronic tags.

Your rights

Data Servis – informace s.r.o. subscribes to the principles established by Regulation 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and is ready to fully cooperate in the exercise of your rights.

According to GDPR, your rights are:

  • The right of the subject of OU to be forgotten, to be erased (Article 17 GDPR)
  • The right of the data subject to be informed of the data held by the controller or processor about the data subject (Article 15 GDPR)
  • The right of the OU subject to object to the processing of his or her personal data (Article 21 GDPR)
  • The right of the OU subject to restriction of processing (Article 18 GDPR)
  • The right of the OU subject to be able to transfer his or her personal data from the controller to a third party (Article 20 GDPR)
  • The right of the OU subject to request a human review in the event of automated decision-making (Article 22 GDPR)
  • The right of the OU subject to update their personal data so that an out-of-date version does not cause them harm (Article 16 GDPR)

Erasure (forgetting) – Your personal data will be erased except for data necessary for the performance of a legal obligation, data necessary for the defence of legal claims or data necessary for the protection of public interests.

Access (knowledge of the data we hold about you) – you will be provided with a copy of any personal data we hold about you except for our intellectual property or our trade secrets and where personal data of others may be transferred.

Object to the processing of personal data – you may object at any time and this will be dealt with appropriately so as not to prejudice your interests. You may object where the processing is necessary for the purposes of the legitimate interests of the relevant controller or third party or to the processing of personal data for direct marketing or profiling purposes. If you object to processing for direct marketing purposes, your personal data will no longer be processed for these purposes.

Restriction of the processing of personal data – your objection will result in the restriction of the processing of your personal data. Until the objection is resolved, the processing of personal data is restricted.

Transfer of personal data – if you have provided us with your personal data on the basis of a contract or consent, your personal data will be exported to you in a structured commonly used electronic format so that you can transfer it to a third party.

Request a human review in the case of automated decision making – if you have any doubt about the accuracy of an automated decision based on the personal data you have provided, we will ensure that an authorised role carries out the decision.

To update your personal data so that an out-of-date version does not cause you harm – we will ensure that your personal data is updated based on your initiative.

Company Data Servis – informace s.r.o. informs you separately in accordance with Article 21 (4) GDPR that you have the right to object to automated individual decision-making pursuant to Article 21 GDPR and that you have the right to object at any time to the processing of personal data for direct marketing purposes pursuant to Article 21 (2) GDPR (see above). At the same time, Data Servis – informace s.r.o. informs you that if you suspect that your personal data is being processed unlawfully, you have the right to file a complaint with the Office for Personal Data Protection of the Czech Republic.

Personal data protection

The company Data Servis – informace s.r.o. ensures the protection of your personal data with a security management system based on a risk analysis of personal data. The company Data Servis – informace s.r.o. assures you that it continuously assesses the security situation and risks and adjusts its security plans so that your personal data is not compromised. We want to assure you that appropriate procedures and technologies are implemented to ensure information, physical and administrative security by both organizational and technical means. For obvious reasons, we do not list these procedures and mechanisms at this point.
